Lower Burrell has officially set rules and regulations for firework displays in the city.
The rules, formally approved this week, define guidelines for “consumer fireworks,” or fireworks used by the public, and “display fireworks,” larger fireworks used by professional pyrotechnicians.
“It is important that rules are in place preventing people from shooting fireworks at other people’s property or at people themselves,” Mayor Chris Fabry said. “While this is a divided topic, the majority of the feedback we’ve received from residents is in favor of having limitations. This ordinance aligns with the state’s rules.”
The rules only allow Lower Burrell to regulate fireworks up to a certain point. The state law on fireworks governs the sale and use of fireworks, but it also gives municipalities the ability to restrict certain uses of consumer fireworks.
According to the rules, consumer fireworks can’t be used in Lower Burrell without permission of the property owner. They also cannot be directed at another vehicle, person or building.
Operators of consumer fireworks can’t be under the influence of alcohol or drugs, and fireworks must be at least 150 feet from any building or vehicle.
Consumer fireworks can’t be used between 10 p.m. and 10 a.m. except on July 2, 3 and 4, and Dec. 31, when they can be used until 1 a.m. the following day. When July 4 falls on a Tuesday, Wednesday or Thursday, fireworks can be used until 1 a.m. on the immediately preceding and following Saturday and Sunday.
Consumer fireworks also can be used on Memorial Day and Labor Day and the weekends immediately before those holidays.
Violators will be subject to fines. The penalties for a first offense include a summary charge and, if convicted, a fine of up to $500; subsequent offenses committed within three years of a prior citation are punishable by fines of up to $1,000.
