Plum mobile home park appeals borough’s denial of expansion plans

The owner of a Plum mobile home park is appealing the borough’s rejection of its expansion plans.
Plum Creek MHC filed an appeal in Allegheny County Court seeking to reverse the borough zoning hearing board’s denial of its request to add 21 manufactured home sites — for a total of 61 sites — to the property off Hulton Road.
The proposal included upgrading the park’s utility infrastructure, road and lighting, and adding a park management office, new recreation space and a stormwater detention facility.
In its denial, the board and officials cited concerns over flooding that has damaged or destroyed homes in the park. Holiday Park Fire Chief James Sims, Plum’s emergency management coordinator, the Allegheny County Conservation District and six residents of the park opposed the proposal.
In its notice of appeal, Plum Creek MHC, based in Los Angeles, claims the zoning hearing board “abused its discretion and committed errors of law” in denying its application.
While claiming the board violated the borough’s zoning code and the state’s municipalities planning code, and that the evidence and testimony do not support the decision, the notice of appeal does not specify how the board allegedly abused its discretion or committed errors of law.
Matthew Kalina, an attorney representing Plum Creek MHC, did not respond to requests for comment.
Gavin Robb, an attorney for the zoning hearing board, declined to comment on the appeal.
The zoning hearing board submitted the record and exhibits in the case to the court on Monday, Jan. 8. A hearing date had not been scheduled as of Wednesday.
