A Tarentum man facing felony child endangerment charges won’t be tried until next year.
William Richard Nulph, 35, is accused of leaving his toddler outside March 14 while he went into his home to feed his infant.
The toddler was found floating in a backyard swimming pool. She required medical treatment, has since made a full recovery and suffers no lasting effects from the incident, Nulph’s attorney, Christopher Urbano, said at an April preliminary hearing.
Allegheny County police Detective Mark Restori testified during the preliminary hearing Nulph was “pretty distraught” and in the process of doing CPR on his daughter when authorities arrived at his home on East Fifth Avenue.
Nulph did not testify during thehearing. Urbano unsuccessfully argued his client should be charged with a misdemeanor because there wasn’t enough evidence to prove it was more than an isolated incident.
District Judge Carolyn Bengel sent the case to Allegheny County court and a bench trial in front of a judge was supposed to start Monday.
Judge Robert Colville granted a request to continue the case until Feb. 24, 2020, made by the district attorney’s office, according to online court records.
An expert witness prosecutors want to testify at the trial was unavailable this week, District Attorney spokesman Mike Manko said.
Urbano declined to comment until after the trial.
